A domestic violence charge can either be a misdemeanor or a felony, depending on multiple factors. Misdemeanor convictions can result in a fine or up to twelve months in jail. However, felony convictions will result in much heavier fines and longer jail sentences. Both misdemeanor and felony convictions can lead to orders of protection against the convicted on behalf of the victim.

A domestic violence charge will become a felony if the injuries sustained by the victim are severe, or if there was a weapon involved in the incident. The addition of a theft during the incident can also turn the charge into a felony.

While the police do make initial charges, the District Attorney’s office has the ultimate discretion on whether the charge is a felony or misdemeanor, particularly as new evidence is discovered and brought forward.
